Driver Who Fatally Struck Baby Is Sentenced

Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 44-year-old D’Andre Turner of Buffalo has been sentenced by State Supreme Court Justice Penny M. Wolfgang to 1 ½-3 years in prison. 

In November, Turner pleaded guilty to Criminally Negligent Homicide, Driving While Ability Impaired by the Influence of Drugs and two counts of Assault in the Third Degree for striking three people with his car. 

On June 19, 2016, the defendant was driving southbound on Moselle Street in Buffalo, when he suddenly crossed over to the northbound side of the street and struck the 3 victims, killing 7-month-old Nyree Greene and causing physical injury to 23-year-old Shannon Anderson (Nyree's mother) and 28-year-old Britney Davis (Nyree's aunt).  The defendant admitted being under the influence of marijuana. 

“Nothing will bring back young Nyree and for that reason, we send our deepest condolences to her family and loved ones,” says acting DA Flaherty. “Mr. Turner has taken responsibility for this tragic crash and regrets the actions of that evening. It’s a lesson to all of us on the dangers of drinking or taking drugs and driving, especially during this holiday season.” 

Acting DA Flaherty commends the work of the Buffalo Accident Investigation Unit on this case.
