Judge Finds Buffalo Man Guilty Of Murder

Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 20-year-old Marquille Spencer of Buffalo has been found guilty of Murder in the Second Degree and Criminal Possession of a Weapon in the Second Degree by acting New York State Supreme Court Justice Russell P. Buscaglia following a non-jury trial. 

Spencer faces a maximum of 25 years to life in prison when he is sentenced by Justice Buscaglia on February 15, 2017 at 9:30 a.m. 

After reviewing the evidence, Justice Buscaglia found that on October 26, 2015 at about 1:15 p.m., Spencer fatally shot 18-year old Joseph Daniels as he was standing on the corner of Broadway and Woltz Avenue in Buffalo.  

“Our thoughts and prayers are with the family of Mr. Daniels who died far too young and far too violently,” says acting DA Flaherty

This marks the 37th non-vehicular homicide conviction obtained this year by the Erie County District Attorney’s Office under the leadership of acting DA Flaherty. 

Acting DA Flaherty commends the superior investigative work of the Buffalo Homicide Squad, especially Detectives Christopher Sterlace, Antonio Borrelli, Daniel Redmond and Reginald Minor. 

Felony Trial Bureau Chief John G. Schoemick and Assistant District Attorney Lauren Nash prosecuted the case.
