Erie County District Attorney John J. Flynn announces that the Erie County Department of Probation’s Conditional Release Commission has denied a request by 51-year-old Gabriele Ballowe for early release from her one-year jail sentence. 

State Supreme Court Justice Christopher J. Burns handed down the sentence in December 2016 after Ballowe pleaded guilty to the charge of Leaving the Scene of an Incident Without Reporting Resulting in Serious Physical Injury. 

On December 22, 2013, Ballowe was driving on Route 5 in Evans when she struck and killed a pedestrian, 52-year-old Barry Moss of Evans and fled the scene. 

Ballowe applied for early release under a program that allows offenders sentenced to a year in jail or less to serve the remainder of their term in the community under the supervision of the Erie County Department of Probation. 

“Ms. Ballowe committed a serious crime and in response to her request, our office vehemently opposed any opportunity for her to avoid serving her full sentence,” says DA Flynn.“We commend the Erie County Department of Probation for making the right decision.” 

Assistant District Attorney Nicholas T. Texido of the DA’s Appeals Bureau handled the case on behalf of the DA’s Office.
