Erie County District Attorney John J. Flynn announces that 34-year-old Timothy DiCenzo of Buffalo was sentenced by State Supreme Court Justice M. William Boller to 35 years in prison plus 20 years post-release supervision.             

In January, DiCenzo pleaded guilty to two counts of Rape in the First Degree. 

DiCenzo admitted to the daylight rape on November 3, 2015 of a woman near Hillery Park Elementary School and the May 7, 2013 rape of a woman at Southside Elementary School. 

DiCenzo was identified as the perpetrator in both rapes after DNA testing positively linked him to the crimes. 

Justice Boller also issued orders of protection for the victims, requiring the defendant not to have any contact with them until November of 2068. 

DA Flynn praised the work of the Buffalo Police Detectives in the Sex Offense Squad, including Mark Costantino and Jacqueline Sullivan and made special mention of the patrol officers of the Buffalo Police Department’s A District, including James Reese. 

“I want to thank the dedicated members of the Buffalo Police Department who worked on this case, but even more so, I want to thank the courageous survivors of these vicious attacks,” says DA Flynn. “If it were not for their bravery, and their willingness to come forward to confront their attacker and hold him responsible, he would still be out there today.” 

Domestic Violence Bureau Chief Lynette Reda, Special Victims Bureau Chief Rosanne E. Johnson and Assistant District Attorney Ryan D. Haggerty prosecuted the case.
