Erie County District Attorney John J. Flynn, Eden Police Chief Michael Felschow and NYSP Major Steven Nigrelli announce that 48-year-old Wayne Kozak of Eden is in jail in Erie, Pennsylvania on an arrest warrant for a charge of murder.

At 3:59 p.m. on Thursday, April 20, Eden Police responded to 8925 East Eden Road where they found 79-year-old Mary Kozak fatally shot.

Her son, Wayne Kozak was located several hours later at a motel in Erie, Pennsylvania and was taken into custody.

Kozak was arraigned in Erie District Court (PA) by Judge Paul Manzi on a fugitive charge and was remanded to jail without bail.

A future court appearance will be held to determine the extradition process.

“Thanks to great police work by the Eden Police Department and New York State Police, this suspect was located and apprehended without incident,” says DA Flynn. “We are now working with authorities in Pennsylvania to bring him back to Western New York to face the charge of Murder in the Second Degree.”
