DA Flynn announces indictment with BPD Homicide Det. Antonio Borrelli and ADA Gene Partridge

Erie County District Attorney John J. Flynn announces that 35-year-old Leron Bailey of Buffalo has been arraigned by Acting Erie County Court Judge James A. W. McLeod on an indictment charging him with Murder in the Second Degree, Attempted Murder in the Second Degree, and two counts of Criminal Possession of a Weapon in the Second Degree for the shooting death of a 20-year-old woman.

It is alleged that on June 24, 2013, the defendant fired multiple shots into a vehicle parked at the corner of Stevens Avenue and East Ferry Street in Buffalo, striking one man in the chest and another young woman in the heart.

The man, who was the intended target of the shooting, received medical treatment and recovered, but 20-year-old Diamond Toler of Buffalo who was seated in the backseat of the car was killed.

Bailey is currently serving a five year prison sentence on an unrelated weapons possession charge from 2013 at Groveland Correctional Facility in Livingston County.

Bailey faces a maximum sentence of 50 years to life in prison if he is convicted of all the charges in the 2017 indictment.

DA Flynn commends the Buffalo Police Homicide Squad for their investigative work, including Detective Antonio Borrelli and former detective, Salvatore Valvo, who is now a Confidential Criminal Investigator with the DA’s Office.

Assistant District Attorney Eugene T. Partridge III of the DA’s Homicide Bureau is prosecuting the case.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
