Erie County District Attorney John J. Flynn announces that State Supreme Court Justice Paul B. Wojtaszek has found 49-year-old Nathaniel C. Myers of Buffalo guilty of one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony). Justice Wojtaszek rendered his decision this morning following a four-day bench trial that began on Monday, convicting the defendant of the highest charge in the indictment against him.  

On Sunday, February 14, 2021, members of the Buffalo Police Department Gun Violence Unit executed a search warrant at the defendant’s apartment on Oberlin Avenue near Walden Avenue in the City of Buffalo. An illegal handgun was found in the defendant’s bedroom. Myers, who was on parole at the time of the crime, was linked to the illegal gun through DNA evidence.

Myers faces a maximum of 25 years to life in prison when he is sentenced as a persistent violent felony offender on Friday, November 18, 2022 at 9:30 a.m. He continues to remain held without bail.

DA Flynn commends the Buffalo Police Department Gun Violence Unit for their work in this ongoing investigation.  

The case is being prosecuted by Assistant District Attorney David M. Zak of the Felony Trials Bureau, Assistant District Attorney Frank A. Strano of the Major Crimes Unit and Assistant District Attorney Jerry Marti of the Appeals Bureau.
