Buffalo Man Sentenced for Shooting that Killed an Innocent Bystander

Erie County District Attorney John J. Flynn announces that 36-year-old Leron Bailey of Buffalo was sentenced by State Supreme Court Justice Christopher J. Burns to 65 years to life in prison.

On June 24, 2013, Bailey fired multiple shots into a vehicle parked at the corner of Stevens Avenue and East Ferry Street in Buffalo, striking the man in the driver’s seat in the chest and a woman in the backseat in the heart. The man, who was the intended target of the shooting, received medical treatment and recovered, but 20-year-old Diamond Toler of Buffalo was killed.

In January 2018, a jury found Bailey guilty of one count of Murder in the Second Degree, one count of Attempted Murder in the Second Degree and two counts of Criminal Possession of a Weapon in the Second Degree.

DA Flynn commends the Buffalo Police Homicide Squad for their investigative work, including Detective Antonio Borrelli and Salvatore Valvo, former detective and Confidential Criminal Investigator with the DA’s Office.

Assistant District Attorneys Eugene T. Partridge III and Louis C. Mussari of the DA’s Homicide Bureau prosecuted the case.
