Erie County District Attorney John J. Flynn announces that 22-year-old Heriberto Rivera-Marti, Jr. of Buffalo pleaded guilty before Erie County Court Judge Kenneth Case to three counts of Criminal Sale of a Controlled Substance in the Third Degree.
On three separate dates between February 9, 2017 and March 6, 2017, the defendant sold a mixture of heroin and fentanyl to an undercover officer in a parking lot on Buffalo’s Lower West Side. On one occasion, the mixture contained heroin, fentanyl and cocaine.
Rivera-Marti pleaded guilty to the highest charge. He faces a maximum of 9 years in prison when he is sentenced on July 9, 2018 at 9:30 a.m.
DA Flynn commends the investigative work by the New York State Police Community Narcotics Enforcement Team and the Amherst Police Department.
Paul J. Williams, III, Chief of the DA’s Narcotics Bureau, prosecuted the case.
