Erie County District Attorney John J. Flynn announces that 26-year-old Andre Davis of Buffalo was sentenced today by Erie County Court Judge James Bargnesi to 3 ½ years in state prison plus 2 ½ years post release supervision for his Criminal Possession of a Weapon in the Second Degree conviction and 3 ½ years in state prison plus 2 years post release supervision for his Criminal Possession of a Controlled Substance in the Third Degree conviction.  These sentences will run concurrently.   

On July 30, 2017, Buffalo Police Department narcotics officers executed a search warrant at a house on West Avenue in the City of Buffalo. Davis and co-defendant David Douglas were present as narcotics officers entered the home. Police recovered 114 bags of heroin and fentanyl, packaged for sale, from Davis’ pocket. Also, officers recovered two, loaded semi-automatic pistols located near the defendants.

DNA evidence linked the .45 caliber pistol to Davis and the 9mm pistol to Douglas.

“Getting guns and drugs off the streets is a priority of mine.” says DA Flynn “In this case we were able to do both.”

DA Flynn commends the thorough investigative work by Detectives Bart Adams, Leo McGrath and Tom Nunan of the Buffalo Police Department.

Assistant District Attorney James W. Mansour, II of the DA’s Narcotics Bureau prosecuted the case.
