Doctor Indicted for Sexually Abusing Two Female Patients

Erie County District Attorney John J. Flynn announces that 68-year-old Mark D. Fisher of Kenmore was arraigned on Friday morning before State Supreme Court Justice M. William Boller on an indictment charging him with one count of Sexual Abuse in the First Degree (Class “D” felony) and two counts of Forcible Touching (Class “A” misdemeanors).

It is alleged that on or about August 13, 2019, the defendant, while working as a physician at the ECMC Outpatient Behavioral Health Center in the Village of Depew, subjected an adult female patient to sexual contact by forcible compulsion. The defendant is accused of intentionally and forcibly touching the intimate parts of the victim during the incident.

It is further alleged that on or about August 14, 2019, the defendant, while working as a physician at the ECMC Outpatient Behavioral Health Center in the City of Buffalo, intentionally and forcibly touched the intimate parts of a second adult female patient.

Fisher is scheduled to return on Wednesday, November 2, 2022 at 9:30 a.m. for a pre-trial conference. He remains released on his own recognizance.

DA Flynn commends Detective Nicole Wrazen of the Buffalo Police Department Special Victims Unit, Detective Rene Smith and Officer Timothy Stranc of the Village of Depew Police Department, and Investigator Laura Starkey of the New York Justice Center for the Protection of People with Special Needs for their work in these investigations.

The case is being prosecuted by Assistant District Attorney Rachel Kranitz McPhee of the Special Victims/Domestic Violence Bureau.
