Heroin Dealer Sentenced on Felony Drug Charges

Erie County District Attorney John J. Flynn announces that 22-year-old Heriberto Rivera-Marti, Jr. of Buffalo has been sentenced by Erie County Court Judge Kenneth Case to 2 ½ years in prison.

On three separate dates between February 9, 2017 and March 6, 2017, the defendant sold a mixture of heroin and fentanyl to an undercover officer in a parking lot on Buffalo’s Lower West Side. On one occasion, the mixture contained heroin, fentanyl and cocaine.

The defendant pleaded guilty to three counts of Criminal Sale of a Controlled Substance in the Third Degree, the highest charges in the indictment, in April 2018.

DA Flynn commends the investigative work by the New York State Police Community Narcotics Enforcement Team and the Amherst Police Department.

Paul J. Williams, III, Chief of the DA’s Narcotics Bureau, prosecuted the case.
