Jury Finds Buffalo Man Guilty on Weapon Charge

Erie County District Attorney John J. Flynn announces that a jury has found 45-year-old Don Lewis of Buffalo guilty, as charged, of one count of Criminal Possession of a Weapon in the Second Degree.

On November 24, 2016, at approximately 3 a.m., a witness saw the defendant holding a gun while assaulting a female victim on Fillmore Avenue and Van Gorder Street in the City of Buffalo. The witness called Buffalo Police who located the defendant in his vehicle, and a gun was found near his feet. The weapon was submitted for DNA analysis, which matched the defendant.

Lewis faces a maximum of 15 years in prison when he is sentenced by State Supreme Court Justice Deborah A. Haendiges on Monday, September 10 at 11 a.m.

DA Flynn commends the investigative work of Buffalo Police Officers AJ Ortiz, Brian Griffin and Erin Trevean.

The case was prosecuted by Assistant District Attorneys Timothy J. Garvin and Rebecca L. Schnirel of the DA’s Domestic Violence Bureau.
