Erie County District Attorney John J. Flynn announces that State Supreme Court Justice M. William Boller has sentenced both 40-year-old Isreal Hernandez of Buffalo and 33-year-old Daniel Colon of Buffalo to 7 years in prison followed by 5 years of post-release supervision.

In the early morning of February 1, 2017, the defendants forcibly entered a home on Carolina Street in the City of Buffalo. Defendant Colon pulled out a gun and threatened one victim by pointing the weapon at his face. The other victims in the home noticed a gun in defendant Hernandez’s waistband. The victims were able to get the defendants, who are known to the victims, to exit the home. A short time later, the defendants broke through the door, entered the home again, but fled when they heard police sirens.

Buffalo Police officers responded and apprehended the two defendants nearby. Officers searched the surrounding area, but no guns were recovered.

Justice Boller found both defendants guilty of Burglary in the Second Degree and Menacing in the Third Degree following a non-jury trial in May 2018.

In addition to their sentences, orders of protection were issued for the victims.

The case was prosecuted by Assistant District Attorney Amy Beatrice Benedict of the DA’s Felony Trials Bureau and Assistant District Attorney Megan E. Mahoney of the DA’s Justice Courts.
