Accused Drunk Driver Arraigned on Felony Vehicular Assault Charge for Hitting Two Pedestrians

UPDATE (2/2/2023): The defendant pleaded guilty to one count of Reckless Driving and one count of Driving While Ability Impaired (misdemeanors) before Buffalo City Court Judge Gary Wilson on February 2, 2023. The defendant was sentenced to a one-year conditional discharge. She was also ordered to pay a $400 fine and her driver's license was suspended for 90 days.

Erie County District Attorney John J. Flynn announces that 35-year-old Schvonne D. Mushat of Buffalo was arraigned on Sunday morning before Buffalo City Court Judge Gary Wilson on one count of Vehicular Assault in the First Degree (Class “D” felony) and one count of Driving While Intoxicated (Class “A” misdemeanor).

It is alleged that on Sunday, October 23, 2022, at approximately 12:30 a.m., the defendant was driving a vehicle, while under the influence of alcohol, when she hit two pedestrians on the 400 block of East Amherst Street in the City of Buffalo.

Both victims were taken by ambulance to ECMC with serious physical injuries. One victim, a 58-year-old man, remains hospitalized. The second victim, a 37-year-old man, was treated for non-life threatening injuries.

Mushat is scheduled to return on Friday, October 28, 2022 at 9:30 a.m. for a felony hearing. She was released on bail set at $10,000 cash, bond, property, partially secured bond or under supervision.

If convicted of the highest charge, Mushat faces a maximum sentence of 7 years in prison.   

DA Flynn commends the Buffalo Police Department for their work in this investigation.

The case is being prosecuted by Assistant District Attorney Christine O. Murray of the Vehicular Crimes Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
