Judge Finds Defendant Guilty of Murder in Fatal Shooting

Erie County District Attorney John J. Flynn announces that Erie County Court Judge Sheila A. DiTullio has found 24-year-old Tevin McCutcheon of Buffalo guilty on one count of Murder in the Second Degree, a Class “A” violent felony, and one count of Criminal Possession of Weapon in the Second Degree, a Class “C” felony.

Judge DiTullio rendered her decision today following an 8-day bench trial that occurred last month. The defendant was found guilty on the highest count in the indictment against him.

On May 20, 2017, the defendant fatally shot 23-year-old Jonathan Grumble of Buffalo whose body was found in a vacant lot on Quincy and Ashley Streets in the City of Buffalo. 

McCutcheon a maximum of 25 years to life in prison when he is sentenced on Wednesday, February 6 at 9:30 a.m. The defendant remains remanded without bail. 

DA Flynn commends the Buffalo Police Department Homicide Squad, including Detective Antonio Borrelli and retired Detective Dan Redmond.

The case was prosecuted by Assistant District Attorney Christine M. Garvey of the DA’s Homicide Bureau and Assistant District Attorney Danielle N. D’Abate of the DA’s Training/Special Projects Bureau.
