Erie County District Attorney John J. Flynn announces that 36-year-old Howard Scholl, III of Town of Tonawanda has been arraigned before Amherst Town Court Justice Kara Buscaglia on one count of Falsifying Business Records in the Second Degree and one count of Insurance Fraud in the Fifth Degree. Both charges are Class “A” misdemeanors.

It is alleged that on Saturday, January 19, 2019, at approximately 11:50 p.m., the defendant was driving a SUV on Englewood Avenue in the Town of Tonawanda when it was involved in a crash with another vehicle. The defendant is accused of causing a false report to be made that his wife was the driver when the collision occurred. It is further alleged that the defendant notified his insurance provider that his wife was the driver of the vehicle.

The defendant is an officer with the Town of Tonawanda Police Department who was off-duty at the time of the alleged incident.

Scholl is scheduled to return on Tuesday, July 10, 2019 at 10 a.m. He was released on his own recognizance.

The defendant’s wife, 33-year-old Aimee Scholl, was arraigned on one count of Falsifying Business Records in the Second Degree. She is also scheduled to return on July 10, and was released on her own recognizance.

The case is being prosecuted by Chief Candace K. Vogel of the DA’s Special Investigations and Prosecutions Unit (SIP).

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
