Intoxicated Driver Pleads Guilty for Crash on Kensington Expressway

Erie County District Attorney John J. Flynn announces that 30-year-old Rodney Borden, Jr. of Buffalo pleaded guilty before Erie County Court Judge Kenneth Case to one count of Vehicular Assault in the First Degree, a Class “D” felony. The defendant pleaded guilty on Thursday, June 6, 2019.

On October 15, 2018, at approximately 11:30 p.m., the defendant, while under the influence of alcohol, was driving a vehicle the wrong way on the inbound Kensington Expressway/Route 33 near Locust Street in the City of Buffalo when he crashed into another vehicle head-on.

The female driver of the other vehicle was taken to ECMC, and she continues to recover from serious injuries she suffered as a result of the crash.

Borden faces a maximum of 7 years in prison when he is sentenced on Tuesday, August 27, 2019 at 2 p.m.

DA Flynn commends Officer Mark Andrzejak of the Buffalo Police Department Accident Investigation Unit for his work in the investigation.

The case was prosecuted by Assistant District Attorney Christopher M. McCarthy of the DA’s Vehicular Crimes Bureau.
