Erie County District Attorney John J. Flynn announces that 46-year-old Allen Kazmierczak of Buffalo has been arraigned before State Supreme Court Justice Russell P. Buscaglia on one count of Murder in the Second Degree, a Class “A-1” felony.
The defendant is accused of fatally shooting his wife, 52-year-old Melissa Kazmierczak, inside their home on Stanton Street in the City of Buffalo on August 4, 2019.
Kazmierczak is scheduled to return on September 23, 2019 at 9:30 a.m. for a pre-trial conference. He remains held without bail.
If convicted on the charge, he faces a maximum of 25 years to life in prison.
DA Flynn commends Det. Scott Malec of the Buffalo Police Department Homicide Squad for his work in the investigation.
The case is being prosecuted by Assistant District Attorney Eugene T. Partridge, III of the DA’s Homicide Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
