Erie County District Attorney John J. Flynn announces that 50-year-old Antwan Diggs of Buffalo has been arraigned before Buffalo City Court Judge Betty Calvo-Torres on one count of Criminal Sexual Act in the First Degree, a Class “B” violent felony, one count of Sexual Abuse in the First Degree, a Class “D” felony, and one count of Forcible Touching, a Class “A” misdemeanor.
It is alleged that on August 19, 2019, at approximately 2:30 p.m., the defendant engaged in sexual conduct with another person by forcible compulsion at the location in the City of Buffalo. It is further alleged that the defendant forcibly touched the victim and subjected the victim to sexual contact by forcible compulsion.
Diggs is scheduled to return on Monday, October 21, 2019 at 9:30 a.m. A no-contact order of protection was issued on behalf of the victim.
If convicted on all charges, Diggs faces a maximum of 25 years prison.
DA Flynn commends Detective Mark Costantino of the Buffalo Police Department Special Victims Unit for his work in the investigation.
The case is being prosecuted by Rosanne E. Johnson, Chief of the DA’s Special Victims Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
