Erie County District Attorney John J. Flynn announces that a jury has found 30-year-old Indaleccio Rodriguez Escalera of Buffalo guilty, as charged, of one count of Attempted Murder in the Second Degree and one count of Assault in the First Degree, both Class “B” violent felonies. The jury rendered their verdict after one day of deliberations following a one-week trial. 

On April 24, 2019, at approximately 5:15 p.m., the defendant approached the victim as he was seated in his SUV on East Eagle Street near Montgomery Street in the City of Buffalo and attempted to cause death of that individual by shooting him multiple times. The defendant continued to shoot at the victim as he exited the vehicle and attempted to run from the gunfire. 

The victim was struck by gunfire four times, but survived his injuries. 

Rodriguez Escalera faces a maximum of 25 years in prison when he is sentenced on Wednesday, March 11, 2020 at 2:00 p.m. by State Supreme Court Justice Russell P. Buscaglia. He remains held without bail.
