Erie County District Attorney John J. Flynn announces that 19-year-old Anthony J. Ciccarelli of Town of Tonawanda has been arraigned before Cheektowaga Town Court Justice David M. Stevens on one count of Reckless Endangerment in the First Degree, a Class “D” felony, one count of Criminal Possession of a Firearm, a Class “E” felony, and one count of Criminal Possession of Stolen Property in the Fourth Degree, a Class “E” felony.

It is alleged that on Thursday, March 5, 2020, at approximately 5:53 p.m., the defendant discharged a handgun that was in his pocket at a restaurant at the Walden Galleria. The gunfire struck his girlfriend in the upper right leg.

The handgun was allegedly stolen from Niagara Falls and was not registered to the defendant.

The victim was taken to ECMC to be treated for the injury.

Ciccarelli is scheduled to return on Wednesday, March 11, 2020 at 8:30 a.m. for a felony hearing. Justice Stevens set bail at $1,500 cash or $5,000 bond.

If convicted on the charge, Ciccarelli faces a maximum of 7 years in prison.

DA Flynn commends the Cheektowaga Police Department for their work on the case.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
